EGBA Proposes Changes for German iGaming Market

The European Gaming and Betting Association (EGBA) has outlined several recommendations aimed at improving the proposals for a Third State Treaty on gambling.
EGBA welcomes the progress towards developing a new online gambling regulation but warns that the draft treaty proposals are inconsistent, overly restrictive in the context of current consumer demand and jeopardise the task of developing a fully functioning online gambling market in Germany.
âA new online gambling regulation is badly needed in Germany, but these new proposals could make the current regulatory dysfunction even worse. An attractive product offer is absolutely essential to achieving a safe and well-channelled gambling environment â but the proposed restrictions would prevent this,â Maarten Haijer, Secretary-General of EGBA, said.
Given the importance of channelling, consumer choice and the âshop-aroundâ nature of online betting, EGBA is concerned that the restrictions proposed in the new state treaty will undermine the success of the future online gambling regulation. Specifically, the cumulative effect of the current product restrictions and the comprehensively restricted access to online casino games, which has been part of the European Commissionâs repeated criticism of Germanyâs gambling regulations.
To ensure this new regulation is a success, EGBA makes the following recommendations:
- Online casino: A full product range is essential to support effective channelling; there should be no opt-out for the LĂ€nder when it comes to the regulation of casino games.
- Bet types: Extensive restrictions should be avoided when defining permissible bet types. Any restrictions on live betting would undermine the objective of channelling consumers.
- Deposit limits: A mandatory cross-provider deposit limit of EUR 1000 will be difficult to implement on a technical level and raises concerns about data protection. A recent study found that the setting of voluntary deposit limits is effective and gamblers who set their own deposit limits would spend significantly less money, compared to players who had not.
- Player account activity: The proposed waiting times for switching between products and operators are not justified and will undermine channelling because they ignore the âshop-aroundâ nature of online betting behaviour and the nature of price and odds comparisons.
- Regulatory authority: EGBA welcomes the proposal to set up a central competent regulatory authority but has concerns about how long it will take to set up and how this could affect licensing decisions.

Network 10 Breaches Gambling Ad Rules During Formula 1 Grand Prix Broadcast

Network Ten has been found in breach of broadcasting rules after airing gambling advertisements during the australian Formula 1 Grand Prix in March 2024.
An Australian Communications and Media Authority (ACMA) investigation found four gambling ads were aired at prohibited times during a broadcast of the first practice round of the Grand Prix.
Under the Commercial TV Code of Practice (the Code), gambling promotions cannot be shown during broadcasts of sporting events between 5am and 8.30pm, including the five minutes before and after the event.
Authority member Carolyn Lidgerwood said the rules around gambling advertisements on TV are there to protect the community from gambling related harms.
âBroadcasters should have strict controls in place to ensure compliance with the restrictions on gambling ads during sporting events,â Ms Lidgerwood said.
Practice rounds and qualifying rounds for motorsports are subject to the same restrictions on gambling advertising as the main event itself.
This is the first breach by Network 10 of the gambling advertising rules in the Code. During the investigation, Network 10 submitted that the broadcasts occurred due to human error.
Following the ACMAâs breach finding, Network 10 voluntarily improved the planning, checks and balances it has in place for ad scheduling and has, at the ACMAâs request, agreed to review its processes to introduce additional quality controls.
Network 10 will also train staff to avoid similar issues in the future and will provide a written progress report to the ACMA.
In a separate investigation in 2024, the ACMA found that streaming service 10 Play, provided by Network 10, breached online gambling advertising rules during two live-streamed sports events.
âThe ACMA will closely monitor these actions and Network Tenâs compliance with the broadcasting and online gambling advertising rules,â Ms Lidgerwood said.

Washingtonâs Lottery Achieves Nationâs Highest Level of Responsible Gambling Certification

Washingtonâs Lottery announced that it has achieved the highest level of responsible gambling certification in the country. As acknowledged by the National Council on Problem Gambling (NCPG) and the North American Association of State and Provincial Lotteries (NASPL), Washingtonâs Lottery officially was certified for âResponsible Gambling Verification Best Practices at the Sustaining Levelâ in December 2024, the culmination of a process that began with certification at the Planning Level in 2019 and Implementation Level in 2021.
Washingtonâs Lottery is only the third state lottery in addition to Virginia and Ohio to achieve this milestone. NCPG and NASPL also recognize nine other state lotteries that have achieved a similar certification through the World Lottery Association.
âI canât begin to express how proud I am of the work our team has done to achieve this important standard. We have a unique obligation as a state agency that sells a gambling product and need to balance the goal of raising money for important state initiatives like education with the need to acknowledge and assist the small percentage of players who may experience gambling-related distress. We take that work very seriously and weave it into all aspects of our jobs,â Kristi Weeks, Director of Legal Services for Washingtonâs Lottery, said.
To receive the Sustaining Level certification, Washingtonâs Lottery was evaluated by a team of four independent experts, who reviewed the lotteryâs efforts in eight key categories related to responsible gambling: planning, employee training, retailer training, public education and awareness, product oversight, research, advertising, and resources.
âThe key to our success has been the integration of responsible gambling initiatives into each and every employeeâs position rather than centralizing it into only one or a few positions,â Weeks added.
